Notice is hereby given that on Thursday, April 3, 2025, at 7:30 p.m., prevailing time, in the West Brandywine Township Building, located at 198 Lafayette Road, West Brandywine, Pennsylvania 19320, the Board of Supervisors of West Brandywine Township shall hold a public hearing to consider a proposed amendment to the West Brandywine Township Zoning Ordinance. The maximum occupancy of the meeting room where the hearing is being held is 115 occupants, remote attendance is also available by clicking on the ZOOM link posted on the Townships webpage wbrandywine.org the day of the hearing.
Title: AN ORDINANCE AMENDING THE ZONING MAP OF WEST BRANDYWINE TOWNSHIP BY EXPANDING THE GENERAL COMMERCIAL OVERLAY DISTRICT, AND BY AMENDING THE CODE OF WEST BRANDYWINE TOWNSHIP, AS AMENDED, BY AMENDING CHAPTER 200, ALSO KNOWN AS THE WEST BRANDYWINE TOWNSHIP ZONING ORDINANCE OF 1984, AS AMENDED, TO AMEND ARTICLE XII (“GENERAL COMMERCIAL OVERLAY DISTRICT”), SECTION 200-56 (“AREA AND BULK REGULATIONS”), SUBSECTION B (“AREA AND BULK REGULATIONS FOR PLANNED COMMERCIAL DEVELOPMENT”) TO MODIFY SUBSECTION (1)(A) TO PERMIT MODIFICATION OF THE MINIMUM TRACT SIZE REQUIREMENTS OF SECTION 200-56(B)(1)(A) FOR CORNER TRACTS BY APPROVAL OF THE BOARD OF SUPERVISORS OF WEST BRANDYWINE TOWNSHIP.
Summary: The proposed Ordinance: Section 1: Zoning Map Amendment. The West Brandywine Township Zoning Ordinance of 1984, as amended Chapter 200, Zoning, shall be amended as follows: A. Article III. Establishment of Districts, Section 10, Zoning Map. Section 200-10. Zoning Map. Shall be amended as follows to expand the General Commercial Overlay District: The location and boundaries of districts shall be shown in the map attached hereto and made part of this chapter. The map shall be designated as the “West Brandywine Township Zoning Map.” The map and other data shown thereon shall be as much a part of this chapter as if fully described thereon. Section 2: Zoning Ordinance Amendment, Article XII (“General Commercial Overlay District”), Section 200-56 (“Area and bulk regulations.”), Subsection B (“Area and bulk regulations for planned commercial development”) is hereby amended to modify Subsection (1)(a), which shall provide as follows:(1) Minimum tract size.(a) Tract: five acres, provided, however, that the minimum tract size for any tract with frontage on two or more public streets shall be three acres Section 3: Severability. This Ordinance is severable. If any section, subsection, sentence, clause or phrase of this Ordinance is held to be illegal, invalid or unconstitutional, the remaining provisions shall not be affected or impaired. Section 4. Applicability. This Ordinance repeals any prior ordinance or portion thereof to the extent that such prior ordinance or portion thereof is inconsistent with this Ordinance. Section 5: Effective Date. This Ordinance shall become effective five (5) days after enactment as provided by law.
