Conditional Use Hearing Notice

NOTICE

Notice is hereby given that on October 28, 2025 at 6:30 p.m., prevailing time, in the West Brandywine Township Building, located at 198 Lafayette Road, West Brandywine, Pennsylvania 19320, the Board of Supervisors of West Brandywine Township shall conduct a public hearing on the conditional use application of Horseshoe Village Associates, L.P., 1518 Meadowbrook Lane, West Chester, PA 19380.

The property subject to the application is 1616 Horseshoe Pike (S.R. 322), UPI No. 29-4-133, located in the RM-Rural Mixed Use Zoning District and the General Commercial Overlay Zoning District.

Applicant seeks a conditional use pursuant to the West Brandywine Township Zoning Ordinance (the “Ordinance”) § 200-55.C.(6) to develop the property with a Wawa convenience store with associated improvements. As part of the project, the applicant is proposing to vacate appx. 520 feet of Swinehart Road (S.R. 4011) and the associated right-of-way and relocate Swinehart Road behind the new proposed building. Applicant also seeks a conditional use pursuant to § 200-83.B of the Ordinance as amended in Ordinance No. 2025-04 to allow the gasoline canopy  associated with the convenience store to be located in the front yard at least 60 feet from the legal right of way of Horseshoe Pike to the closest point of the canopy and at a height of 21’2” measured from the grade of the supporting columns to the highest point of the canopy structure. Applicant also seeks a conditional use pursuant to § 200-83.B of the Ordinance as amended in Ordinance 2025-04 to allow an enclosed area for the storage of trash receptables or dumpsters to be located in the front yard.

The conditional use procedures and standards set forth in Article XXI of the Ordinance shall apply. Any person affected by the application may move to intervene at the public hearing. Intervenors granted party status shall have the right to be represented by legal counsel of their choosing, at their sole cost, and shall have the right to present evidence to the Board of Supervisors. The public hearing will be transcribed by a court reporter.

The conditional use application is available for review during regular business hours at the West Brandywine Township building, 198 Lafayette Road, West Brandywine, Pennsylvania 19320 without charge, or a copy of the application may be obtained for a charge not greater than the cost thereof.
